California privacy law could ease, despite strong voter support
California state officials are considering weakening a privacy law that currently allows patients to take legal action against healthcare providers for the release of medical records without permission. The legislation, AB 439, would protect healthcare corporations from damage awards as long as they can provide an “affirmative defense” when sued by patients. A survey found that 77% of voters support the current medical privacy law. Opponents of AB 439 argue that it eliminates an important financial deterrent against privacy violations.
