Forensic reports are NOT privileged – Ontario Divisional Court

In light of the 2019 LifeLabs data breach, the Information and Privacy Commissioner of Ontario and BC rejected LifeLabs’ claims of privilege over forensic reports pertaining to the cyber attack. Canadian attorney David Fraser notes that this decision, upheld by the Divisional Court, will have significant implications for lawyers who work in cyber incident response and breach coaching. This is noteworthy because such reports were previously considered confidential.
